Terms of Use (LiteraKit)

1. Introduction

Thank you for choosing LiteraKit ("the Application"). These Terms of Use ("Terms") apply to your use of the Application and its services ("Services"). By accessing or using our Services, you confirm that you have read, understood, and agree to these Terms. Our Privacy Policy is incorporated by reference into these Terms. We may update these Terms from time to time; your continued use of the Services after any changes constitutes your acceptance of the new Terms. If you do not agree with these Terms, please do not use our Services.

By using our Services, you confirm that you are at least 13 years old or have obtained parental consent.

2. Your License to Use the Application

Subject to your compliance with these Terms, we grant you a limited, personal, non-transferable, and non-exclusive license to use the Application for your own personal, non-commercial use. You agree not to copy, modify, reverse engineer, or otherwise attempt to discover any source code, sell, rent, or transfer any right in the Application.

3. Content and Intellectual Property

All notes, highlights, and content you create within the Application remain your property. You are responsible for ensuring this content does not violate any third-party rights. All content provided by the Application, including its design, text, graphics, software, and other materials, are the intellectual property of the developer.

4. User Conduct

You agree not to misuse the Services. This includes, but is not limited to, using the Application for any unlawful purpose, attempting to gain unauthorized access to the Application or its related systems, or engaging in any activity that disrupts or interferes with the integrity or performance of the Services.

5. Subscriptions and Free Trial

LiteraKit offers premium features through monthly and yearly subscriptions ("Premium") managed via the Apple App Store.

• Free Trial: The yearly subscription may start with a 2-week (14-day) free trial. The free trial is not available for the monthly subscription. No charges will be made if you cancel before the trial period ends.
• Renewals: Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Subscription Management: Subscriptions may be managed by you, and auto-renewal may be turned off by going to your device's Account Settings after purchase.
• Switching from Monthly to Yearly: Your Yearly subscription will be activated immediately after payment, and any remaining time on your Monthly subscription will be forfeited.
• Switching from Yearly to Monthly: Your Yearly subscription will continue until its expiration date. Your Monthly subscription will become active after the Yearly subscription period ends.

6. Cancellations and Refunds

• All purchases and subscriptions are managed by the Apple App Store. For any refund requests, you must contact Apple directly, as we do not have the ability to process refunds.
• Cancellations will take effect at the end of the current billing period. No partial refunds are provided for any unused portion of your subscription term.

7. Termination

We reserve the right to modify, suspend, or terminate your access to the Services if we believe you have breached these Terms. If you have an active subscription when your access is terminated, you will not receive a refund for any time remaining on your subscription.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Services will be uninterrupted, error-free, or free from viruses. You use the Services at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, the developer shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Application. Our maximum aggregate liability to you for any paid subscription shall not exceed the total amount of fees paid by you to us in the 12 months prior to the claim.

10. Indemnity

You agree to indemnify and hold the developer harmless from any losses or damages arising out of any claim brought by a third party due to your use of the Services or your violation of these Terms.

11. General Information

Governing Law and Arbitration: These Terms shall be governed by the laws of the Republic of Türkiye. Any dispute arising between you and Baris Yalcinkaya will be resolved by binding arbitration.

Entire Agreement: These Terms represent the entire understanding between you and us and supersede any previous agreements.

Language: This agreement was originally written in English. To the extent any translated version of this agreement conflicts with the English version, the English version controls.
